Given how historic records were indexed and the accuracy of how property information held by Wellington City Council is indexed, we cannot guarantee that absolutely all building permits or issued building consents have been identified. Law and jurisdiction
The information we provide has been made available under sections 10 to 18 (inclusive) of the Local Government Official Information and Meetings Act 1987 only.
Building, plumbing and drainage permits issued under the bylaws made pursuant related to the Local Government Act 1974 have now expired. The bylaws relating to building permits were superseded by the Building Act 1991 and subsequently by the Building Act 2004. Unauthorised or incomplete building, plumbing and drainage permitted work done prior to the implementation of the Building Act 1991 in January 1993, now has the status of an “existing situation”. Unless the building is either dangerous or insanitary, as defined under Sections 121 and 123 of the Building Act 2004, the Council is precluded from taking any further action to require the owner to complete the work in accordance with the original building permit.
Consents and permits
“Building consents" have replaced "building permits" as a result of the implementation of the Building Act 1991, and subsequently the Building Act 2004.
Under Schedule 1 of both Acts, some types of building work are exempt from the need to obtain a building consent. Note that the building consent search does not provide information relating to work done under Schedule 1.
Boundaries
Property boundaries shown are based on the Digital Cadastral Data Base (DCDB). Topographical information shown (such as buildings) is captured by photogrammetric methods. The accuracy of the two methods of data capture is different. Wellington City Council does not guarantee the accuracy of the aerial photo.
The Council does not hold official property boundary information. Relevant certificates of title should be obtained from the Land Titles Office (Land Information New Zealand) and relevant boundary dimension information should be obtained from Land Information New Zealand.
Copyright
The information provided have not had the Copyright established and access is being provided under Section 61 of the Copyright Act 1994.
Wellington City Council do not have the copyright or other intellectual property rights for the information provided, and it may not be copied and otherwise re-used in New Zealand without first establishing copyright or other intellectual property right related restrictions.
