The Environment Court has given David Walmsley one month to remove the structures that block out most views from an apartment on a slope above his property.
Mr Ulusele says that, contrary to the impression given by some media reports, the City Council has always held the view that the structure built by Mr Walmsley was unacceptable – even though it complied with the District Plan – which is why the Council initiated the court action.
“Since 2014 we have sought to have the structure removed or altered because, like most observers, we considered it to a gross intrusion on the lives of Mr and Mrs Aitchison, who live in the apartment.”
Mr Ulusele says that city planning staff will review the decision – but at first reading there do not appear to be any implications that require amendments to the District Plan.
