Have your appeal heard by the Courts

If you want to apply to the Courts to appeal your parking ticket, we must receive your request within 56 days of the ticket being issued.

Submit an appeal to the Council first

If you believe you have grounds to appeal your parking ticket, we advise you to go through our appeal process first. If we decline it, you can then choose to have the matter heard by a court.

Your request must be received before the payment due date. It's a good idea to seek legal advice from a lawyer, community law or Citizens Advice Bureau. You can find information about going to court on the Ministry of Justice website.

Request a court hearing

You can request a defended court hearing if you believe you are not guilty. This will mean you have to appear in court on a specific day.

You will be able to cross examine the Parking Officer. If you do not attend the hearing, the two presiding Justices of the Peace will hear the Parking Officer's evidence and make a decision.

You’ll need to provide:

  • the parking ticket number and licence plate number
  • your full name, postal address and contact details
  • a statement to say you wish to have a court hearing.
  • Once a date has been set by the Justice Department, you will receive a letter advising you of the court hearing date and time.

Make a written submission

You can make a written submission if you wish to admit liability, but want the court to consider mitigating circumstances. It will be read by the Justices of the Peace in Chambers, not in open court.

You’ll need to provide:

  • a written submission, outlining the circumstances relating to the offence, which must include the statement “I accept liability for the infringement”
  • the parking ticket number and licence plate number
  • your full name, postal address and contact details.

It will be forwarded to the court on your behalf, along with any previous correspondence you may have sent.

Cost

The Court may impose additional costs – usually $30. This decision is at the discretion of the Justices of the Peace.
